A group of four lawyers filed a request for an extension of habeas corpus to prevent the arrest of singer Gusttavo Lima. The request, coordinated by lawyer Nelson Wilians, was submitted at 8:42 p.m. to the office of Judge Eduardo Guilliod Maranhão, the same judge who ordered the release of attorney and influencer Deolane Bezerra and 16 others arrested in Operation Integration.
The request, obtained by Tictacnews, was made with the intent to align with the decision that had already benefited Darwin Henrique da Silva, owner of the platform “Caminho da Sorte,” and his son Darwin Henrique da Silva Filho, owner of the betting site “Esportes da Sorte.”
The lawyers request that the preventive detention be revoked “so that [Gusttavo Lima] can continue fulfilling his schedule as a singer, with several contracts signed,” and that “no alternative precautionary measures to detention be imposed on him.” This would include, for example, the cancellation of the singer’s passport suspension, as he is currently in Miami, and the annulment of a possible request for inclusion on Interpol’s wanted list, which could result in potential extradition from the United States.
The request from Wilians’ legal team also explores the discrepancies between the Civil Police and the Public Prosecutor’s Office. This is because when Judge Andréa Calado da Cruz ordered the singer’s arrest, she sided with the police and rejected the arguments of the Pernambuco Public Prosecutor’s Office (MP-PE).
“The Public Prosecutor’s Office, as Your Honor has duly noted, did not even show conviction in filing charges against the suspects, including the petitioner,” the lawyers emphasized.
When contacted by Tictacnews, neither the Pernambuco Public Prosecutor’s Office nor the state’s Civil Police wished to comment on the details of the investigation, citing confidentiality.
After the publication of the report, lawyers Delmiro Dantas Campos Neto, Matteus Macedo, and Cláudio Bessas – the latter already representing Gusttavo Lima – informed Tictacnews that Nelson Wilians’ team does not represent the singer and does not have the necessary legal authorization for such representation.
Indeed, no authorization from Gusttavo Lima delegating representation to Nelson Wilians was found. However, habeas corpus requests do not require such authorization.
Bessas’ legal team even requested the habeas corpus filed by Wilians’ team be disregarded. The authorization presented by Bessas’ team, signed by the singer, dates back to September 4, before the arrest warrant was issued.
According to the law, Gusttavo Lima now has 15 days to officially declare who will represent him.
